Tutela interpuesta por Oscar Mauricio Toro falla a su favor y solicita que el señor Francisco Javier Castaño se retracte ante falsa información replicada
El juzgado Primero Civil Municipal solicitó al ciudadano Francisco Javier Castaño, candidato por el Pacto Histórico, a que se retracte sobre falsa información de inhabilidad por doble militancia de la que acusó a Oscar Mauricio Toro, candidato a la alcaldía de Dosquebradas.
El día 4 de agosto del presente año, el señor Castaño repartió en el Centro Administrativo CAM de Dosquebradas un folleto en donde manifiesta que el candidato Toro no se encontraba habilitado para aspirar a la alcaldía del municipio, lo que afectó su imagen y generó confusión entre el electorado.
Mediante una acción de tutela, el candidato Oscar Mauricio indicó que con la información propinada por el señor Castaño, se vulneraban sus derechos fundamentales a la honra, el buen nombre y la buena imagen, además de confundir a la comunidad.
Por tal motivo, para la protección de los derechos del candidato, el juzgado municipal solicita que el señor Francisco Javier suspenda la distribución de esta información y se retracte de lo divulgado por medio de nuevos volantes que deben ser distribuidos en la misma cantidad y condiciones en que repartió los que difamaban al candidato.
